Terms of Service

Ideas ("the Service", "we", "us") is owned and operated by Peaktrend Limited, a company registered in England. You can contact us at tom@peaktrend.co.uk.

By creating an account or using the Service you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

You must provide accurate registration details and keep your credentials secure. You are responsible for all activity on your account. You must be at least 16 years old to use the Service.

You retain ownership of the ideas, text, images, video links, feedback transcripts, respondent data and other material you submit ("Your Content" or "UGC"). You grant Peaktrend Limited a worldwide, non-exclusive, royalty-free licence to host, display, process and distribute Your Content solely to operate and improve the Service, including showing public ideas in the directory and to respondents you invite.

You represent and warrant that: (a) you own or have all necessary rights to Your Content; (b) Your Content does not infringe any third-party intellectual property, privacy, publicity or other rights; (c) Your Content complies with applicable law and these Terms; and (d) all representations you make about Your Content are accurate.

We do not review, approve or endorse User Content before it appears on the Service. We are not responsible for the accuracy, completeness, legality or quality of any User Content, nor for any loss or damage arising from reliance on it. All use of User Content is at your own risk.

We may, but are not obligated to, monitor, review, edit or remove User Content that we believe violates these Terms or applicable law. We are under no duty to police content and will not be liable for our failure to detect or remove infringing or objectionable material.

You agree not to:

• upload or share unlawful, infringing, harmful, deceptive, defamatory, obscene, hateful or discriminatory content;
• impersonate any person or misrepresent your affiliation;
• attempt to disrupt, reverse engineer or gain unauthorised access to the Service;
• use the Service to harvest personal data or send unsolicited communications;
• submit content that infringes any patent, trademark, copyright, trade secret or other proprietary right;
• use automated means to scrape content beyond what we expose via documented features.

We reserve the right to remove, suspend access to, or refuse to publish any User Content that we reasonably believe breaches these Terms or applicable law, without notice or liability to you. Repeated breaches may result in account termination.

If you believe content on the Service infringes your rights, email us at tom@peaktrend.co.uk with a detailed description of the alleged infringement, including the URL, your contact details, and a statement of good faith belief. We will investigate and take appropriate action in accordance with applicable law.

You agree to indemnify and hold harmless Peaktrend Limited, its officers, employees, agents and affiliates from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or in connection with: (a) Your Content; (b) your use of the Service; (c) your breach of these Terms; or (d) your violation of any third-party right or applicable law.

The Service uses AI to moderate feedback sessions and summarise responses. AI output may be inaccurate or incomplete. You are responsible for how you act on it. We do not warrant that summaries, sentiment scores or themes are correct.

The Service is provided on an "as is" and "as available" basis. We may change, suspend or discontinue features at any time. We will give reasonable notice of material changes where practicable.

You may delete your account at any time by contacting us. We may suspend or terminate your access if you breach these Terms or if required by law. On termination, your right to use the Service ends immediately. We may retain copies of User Content as required by law or for legitimate operational purposes.

To the fullest extent permitted by law, Peaktrend Limited shall not be liable for any indirect, incidental, special or consequential loss, or for any loss of profits, revenue, data or goodwill. Nothing in these Terms limits liability that cannot lawfully be limited (such as for death or personal injury caused by negligence, or fraud).

We are not liable for any User Content, including any errors, omissions, defamation, infringement or loss resulting from it. We are not liable for the conduct of any respondent or third party invited to review your ideas.

Our total aggregate liability arising out of or relating to the Service shall not exceed the greater of (a) the amount you paid us in the 12 months before the claim, or (b) GBP 50.

These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute, save that if you are a consumer you may also bring proceedings in your country of residence.

We may update these Terms from time to time. The "last updated" date above shows when changes took effect. Continued use of the Service after a change constitutes acceptance of the updated Terms.
